Privacy Policy
This policy outlines how Pragathi Logistics Service (PLS) collects, uses, and protects
Customer and Consignment data.
A. Information Collection
PLS collects information necessary to perform logistics services, including:
● Customer/Consignor Data: Name, address, contact details, payment
information (for invoicing).
● Consignment Data: Shipment contents description, origin and destination
addresses, consignee details, and tracking information.
B. Use of Information
The collected data is used exclusively for:
● Processing and fulfilling logistics and transportation services.
● Invoicing, accounting, and debt collection (including enforcement of the 3% per
month interest clause for late payments).
● Tracking shipments and providing status updates.
● Compliance with legal and regulatory obligations.
C. Data Security
PLS implements reasonable administrative, technical, and physical safeguards to
protect information against unauthorized access, disclosure, alteration, or destruction.
D. Data Sharing
PLS does not sell Customer data. Information is shared only as necessary to:
● Third-party service providers (e.g., subcontractors, customs brokers) directly
involved in the shipment’s movement.
● Comply with legal requests, court orders, or government regulations.
Undelivered/Unclaimed Consignments and Demurrage
This document details the procedures and financial consequences for consignments
that are refused or unclaimed.
A. Undelivered or Unclaimed Consignment Procedure
1. Storage: If the consignee refuses or fails to take delivery, PLS will, at the risk
and cost of the Consignor, transport the consignment to a PLS warehouse or
suitable storage facility.
2. Consignor Notification: The Consignor will be immediately informed of the
consignment’s status.
3. Required Instructions: Upon intimation, the Consignor must issue fresh
instructions to PLS within the following timeframe:
● 48 hours for standard goods.
● 24 hours for perishable goods.
4. Re-transportation: Any request for re-transportation will require advance
payment by the Consignor for all new transportation charges, demurrage
incurred, and other associated costs as demanded by PLS.
5. Right to Sell: If the Consignor fails to issue fresh instructions within the
stipulated timeframe, PLS is entitled to sell the consignment. The proceeds,
after deducting all proper charges, expenses (including storage and demurrage),
will be paid to the Customer.
B. Demurrage Charges (Storage/Warehousing)
● Charge Basis: Demurrage, storage, or warehousing charges will commence and
be billed to the Customer if the consignee does not take delivery of the
consignment within 48 hours of the date it was first tendered for delivery.
● Applicable Rate: Charges will be applied as per PLS’s published policy rate for
demurrage/storage/warehousing.
Liability, Claims, and Prohibited Materials
This policy defines PLS’s liability, the scope of the claims process, and a list of
unacceptable goods.
A. Claims and Financial Responsibility
● Claims Process: All claims must be submitted to PLS in writing within the
defined period (not explicitly stated in the input, but should be added for a
complete policy, e.g., 30 days from delivery).
● Claim Settlement Offset: It is strictly noted that the amount of any claim
settlement shall not be used as a deduction against any of the charges due to
PLS (freight, taxes, COF, valuation charges, etc.). The full invoice amount
remains due irrespective of a pending or settled claim.
B. Materials Not Acceptable for Transportation
PLS assumes zero liability for these prohibited goods and will not accept them for
transportation:
1. Hazardous/Dangerous Goods: Will not be accepted. The only exception is if
the goods are demonstrably harmless and non-inflammable.
2. Precious Cargo: Includes Gold, Bullion, Silver bars, Jewellery, Gems, Precious
stones, and other precious metals, Currency notes, Traveler’s cheques,
Antiques, Stamps, and House-hold effects.
3. Prohibited/Controlled Items: Liquor, Perishables, Live-stock, Human remains,
Paints, Firearms, Drugs, and Lewd, Obscene, or Pornographic materials.
